Effective 15 May 2026, an online appeal for a rejected EP or PVP must be initiated and submitted within 14 days from the rejection date at the Expatriate Committee meeting. After that period, the appeal facility is no longer available in the system.

An appeal is not simply a request to review the same file again. The company should identify why the application failed, correct factual weaknesses and present focused evidence that changes how the position, business need or applicant suitability should be assessed. Repeating the original explanation without addressing the rejection usually wastes the limited appeal opportunity.

Appeal, Fresh Application or Refund?

How to Write the Appeal Justification Letter

The justification letter is the argument that connects the rejection reason to the new evidence. It should be concise enough to follow quickly but detailed enough to explain the company's position. A general request for sympathy or an urgent joining date does not establish eligibility.

A practical structure

  • Identify the company, applicant, position and rejected application clearly.
  • Quote or accurately summarise the rejection issue.
  • Respond to each issue separately instead of mixing several explanations.
  • Explain the commercial need for the expatriate position.
  • Connect the applicant's qualifications and experience to the actual duties.
  • Refer to each new supporting document by name.
  • Confirm any corrected salary, reporting line or company information.
  • Have the authorised endorser sign the final letter.

Every statement should remain consistent with the employment contract, job description, organisation chart, ESD position and company records. An appeal that fixes one issue but introduces a new contradiction can weaken the entire submission.

Match Evidence to the Rejection Issue

A useful Malaysia Employment Pass appeal process does not apply the same document pack to every rejection. The employer should diagnose what the committee could not verify and submit evidence that answers that gap.

How to Submit the Online Appeal

Only an authorised company representative with valid ESD Online access can initiate and submit the appeal. The expatriate cannot file it personally.

  1. Log in to the company's ESD Online account.
  2. Open the rejected application records.
  3. Select the Appeal function for the eligible case.
  4. Upload the mandatory and case-specific supporting documents.
  5. Read and acknowledge the disclaimer.
  6. Review the complete file before clicking Submit Appeal.
Review before submission: Once submitted, the appeal application cannot be edited. Documents from the original Expatriate Committee submission are also not editable during the appeal stage.

What Happens After Submission?

A complete appeal may take up to 30 working days to review. The company can track status through ESD Online and should monitor automated notifications. If no update is received after 30 working days, the company may contact the MYXpats Helpdesk for clarification.

If the appeal is incomplete, it may be returned for additional documents or information. The company must respond within the timeframe stated in the return notice. A returned appeal is not permission to restart the 14-day window indefinitely, so the authorised representative should monitor the system closely.

Approval, Rejection or Withdrawal

If the appeal is approved, the company receives a system notification and official approval letter. The company should then continue with the applicable post-approval and endorsement steps rather than assuming the approval alone completes the EP.

If the appeal is rejected by EC-A, the official FAQ notes that an EP case may be referred to the Ministry of Home Affairs Immigration Affairs Division, subject to that authority's procedures and discretion. This should not be treated as an automatic second appeal.

A company can request withdrawal by emailing MYXpats with a cover letter signed by the authorised endorser. The appeal committee will then record the appeal rejection on the basis of withdrawal. Because the application fee is already non-refundable after appeal initiation, withdrawal should be considered carefully.
